Return to India

What changes when you move back to India, and when each change takes effect.

A software engineer moving from Seattle to Hyderabad, a family returning from London after fifteen years, a couple retiring from Doha to Kochi: each return is different, but the same questions follow each of them home.

A return to India is usually planned around a date: the flight home, the start of a school year, the end of a notice period. The Indian rules that follow you home work to different calendars.

Your residential status for income tax is decided for each year, mainly from the days you spend in India and your earlier years of residence; citizenship and Indian income can also matter. Your residence under FEMA follows a different test, which looks at your stay in the previous year and at the purpose and circumstances of your return. Your bank accounts and deposits may need to be redesignated, converted or continued under their own rules once your FEMA status changes, and whether your first Indian return after the move must report assets you still hold abroad depends on your status for that year. These changes rarely arrive together.

Where to begin

Returning from the United States

Retirement accounts, brokerage holdings and employer shares raise questions of their own. There are guides on the 401(k), traditional and Roth IRAs, US brokerage accounts, RSUs and ESPP and US Social Security, and on the documents worth gathering before you leave.

These guides set out the India-side position. The tax, legal and reporting position in the country you are leaving should be reviewed by an appropriately qualified professional there.
